5.4 Cancellations and Refunds

Due to the perishable nature of food products, all sales are generally final once an order has been prepared. If you wish to cancel an order, you must do so before the order has entered the preparation stage. Refund eligibility for food quality issues or errors will be evaluated on a case-by-case basis. 5.5 Gift Cards

Gift cards issued by Anthony's Coal Fired Pizza are subject to separate gift card terms and conditions. Gift cards are non-refundable and have no cash value except where required by applicable law. Lost or stolen gift cards will not be replaced unless required by law.

6. Food Allergen and Nutritional Information

Anthony's Coal Fired Pizza takes food safety seriously. We make reasonable efforts to provide accurate allergen and nutritional information on our Site and in our restaurants.   • Damages resulting from any conduct or content of any third party on or through the Site;
  • Damages resulting from unauthorized access to or alteration of your transmissions or data;
  • Damages arising from food safety incidents where you failed to disclose known allergen sensitivities to restaurant staff.

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF ANTHONY'S COAL FIRED PIZZA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN JURISDICTIONS WHERE LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES IS NOT PERMITTED, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

TO THE EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL CUMULATIVE LIABILITY OF ANTHONY'S COAL FIRED PIZZA TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO ANTHONY'S COAL FIRED PIZZA IN THE THREE (3) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00).

10. Indemnification

You agree to defend, indemnify, and hold harmless Anthony's Coal Fired Pizza and its officers, directors, employees, contractors, agents, licensors, service providers, successors, and assigns from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your violation of these Terms of Service;
  • Your use of or access to the Site or Services;
  • Your violation of any applicable federal, state, or local law or regulation;
  • Your violation of any third-party rights, including intellectual property rights or privacy rights;
  • Any content you submit, post, or transmit through the Site;
  • Any fraudulent, negligent, or wrongful acts or omissions by you;
  • Your breach of any representation or warranty made in these Terms.

We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and in such case, you agree to cooperate with our defense of such claim. You shall not settle any claim covered by this indemnification obligation without the prior written consent of Anthony's Coal Fired Pizza.

11. Governing Law and Jurisdiction

These Terms of Service and any disputes arising out of or relating to them, the Site, or the Services shall be governed by and construed in accordance with the laws of the United States of America and the laws of the state in which Anthony's Coal Fired Pizza's principal place of business is located, without regard to its conflict of law provisions.

You agree that any legal action or proceeding arising out of or relating to these Terms or your use of the Services shall be brought exclusively in the federal or state courts of competent jurisdiction in the United States. You hereby consent and submit to the personal jurisdiction of such courts for the purpose of litigating any such action or proceeding.

Notwithstanding the foregoing, Anthony's Coal Fired Pizza reserves the right to seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of our intellectual property rights or other proprietary rights.

Our Services are controlled and operated from the United States. If you access the Site from outside the United States, you do so on your own initiative and are responsible for compliance with local laws and regulations.

12. Dispute Resolution

12.1 Informal Resolution

Before initiating formal legal proceedings, you agree to first attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the Services informally by contacting Anthony's Coal Fired Pizza at [email protected]. We will make reasonable efforts to resolve the dispute informally within thirty (30) days of receiving your notice.

12.2 Binding Arbitration

If informal resolution is unsuccessful, you and Anthony's Coal Fired Pizza agree that any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by binding arbitration in accordance with the rules of the American Arbitration Association (AAA) or JAMS, at the election of the party initiating arbitration.

The arbitration shall be conducted in English in the United States. The arbitrator shall have the authority to grant any remedy that would otherwise be available in a court of law. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

12.3 Class Action Waiver

YOU AND ANTHONY'S COAL FIRED PIZZA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both you and Anthony's Coal Fired Pizza agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.

12.4 Exceptions

Notwithstanding the arbitration agreement above, either party may seek emergency injunctive relief from a court of competent jurisdiction to prevent irreparable harm pending arbitration. Claims for small claims court matters that fall within the jurisdictional limits of such courts may also be brought there.

13. Term and Termination

These Terms shall remain in full force and effect while you use the Site or Services. Anthony's Coal Fired Pizza reserves the right, in its sole discretion and without notice or liability, to:

  • Deny access to the Site or Services to any person for any reason;
  • Terminate or suspend your account and access to the Services immediately, with or without cause, including if we believe you have violated these Terms;
  • Discontinue or modify the Site or any part thereof at any time without prior notice;

The parties agree that the court or arbitrator shall endeavor to give effect to the parties' original intentions as reflected in the provision, and the other provisions of these Terms shall remain valid and enforceable.

16. Entire Agreement

These Terms of Service, together with our Privacy Policy and any other legal notices published by Anthony's Coal Fired Pizza on the Site, constitute the entire agreement between you and Anthony's Coal Fired Pizza with respect to the Site and Services, and supersede all prior and contemporaneous agreements, representations, warranties, and understandings, whether oral or written, between you and Anthony's Coal Fired Pizza.

No waiver by Anthony's Coal Fired Pizza of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Any failure of Anthony's Coal Fired Pizza to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

18. Force Majeure

Anthony's Coal Fired Pizza shall not be liable for any failure or delay in performance under these Terms that results from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, epidemics, labor disputes, government actions, civil unrest, terrorism, cyberattacks, power outages, internet disruptions, supply chain failures, or any other event that could not have been reasonably anticipated or prevented.

In the event of a force majeure event, we will make reasonable efforts to notify you and resume performance as soon as reasonably practicable. If a force majeure event continues for an extended period, we reserve the right to terminate affected orders or Services without liability.
